Terms of Sale

1. Introduction and Acceptance
These Terms of Sale ("Terms") govern your purchase of cleaning products and related items ("Products") from Cleaning LAB INC. ("Cleaning LAB," "we," "our," or "us") through our online store at cleaning-lab.com.
These Terms apply only to product purchases. For your use of our website generally and our professional cleaning services, please refer to our separate Terms of Service. Our handling of your personal information is governed by our Privacy Policy.
By placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not place an order.
2. Eligibility
You must be at least 18 years of age and have the legal capacity to enter into binding agreements to purchase Products from our online store. By placing an order, you represent and warrant that:

  • You are at least 18 years of age

  • You are purchasing for personal or household use, or for a business you are authorized to represent

  • The information you provide (name, billing address, shipping address, payment details) is accurate, complete, and your own

  • You are not a reseller purchasing for unauthorized commercial redistribution unless you have a separate written wholesale agreement with us

We reserve the right to refuse or cancel any order that does not meet these eligibility requirements.
3. Shipping Territory and Geographic Exclusions
We currently ship to addresses within the 48 contiguous United States only. We do not ship to the following territories due to regulatory and logistical restrictions:

  • California — due to Proposition 65 and Volatile Organic Compound (VOC) regulations

  • Alaska and Hawaii — due to hazardous material ground-shipping limitations

  • Puerto Rico, Guam, U.S. Virgin Islands, and other U.S. territories — due to hazmat territorial restrictions

  • APO/FPO/DPO military addresses — due to hazmat shipping restrictions

  • PO Boxes — due to carrier limitations on hazardous materials

Orders placed to excluded territories will be automatically cancelled and refunded, and we will notify you by email. We are not obligated to fulfill any order to an excluded territory regardless of how it is placed.
4. Orders and Order Acceptance
4.1. Order Submission
Placing an order through our online store constitutes an offer to purchase Products from us. Submission of an order does not by itself create a binding contract.
4.2. Order Acceptance
A binding contract is formed only when we dispatch the order for shipment. Until that moment, we may accept or reject your order at our sole discretion.
4.3. Reasons for Order Rejection
We may reject or cancel an order for any reason, including but not limited to:

  • Suspected fraud, payment irregularity, or chargeback risk

  • Inability to verify your identity or shipping address

  • Geographic exclusion (Section 3)

  • Pricing or product description error (Section 18)

  • Inventory unavailability

  • Quantities exceeding reasonable household or retail use

  • Prior breach of these Terms or our Terms of Service

If we reject or cancel an order after payment has been processed, we will issue a full refund to the original payment method.
5. Pricing, Taxes, and Currency
5.1. Currency and Pricing
All prices are listed in U.S. dollars (USD). Prices are subject to change without notice, but changes will not affect orders that have already been accepted under Section 4.2.
5.2. Sales Tax
Applicable New York State and local sales tax (8.5%) is calculated and added at checkout for orders shipped within New York State and to states where we are obligated to collect tax. Tax is applied to both Product prices and shipping charges where required by law.
5.3. Pricing Errors
In the event of a pricing or product information error on our website, we reserve the right to cancel or refuse any order placed at the incorrect price, even after payment has been processed and order confirmation has been sent. We will notify you and issue a full refund if such cancellation occurs.
6. Payment
6.1. Accepted Payment Methods
We accept payment through:

  • Wix Payments (credit and debit cards)

  • PayPal

All payments are processed by these providers; we do not store complete payment card details on our servers.
6.2. Payment Authorization
By submitting payment information, you authorize us (and our payment providers) to charge your selected payment method for the full order amount, including Products, shipping, and applicable taxes.
6.3. Failed Payment and Chargebacks
If a payment is declined, reversed, or charged back after Products have been shipped, you remain liable for the full order amount and any associated recovery costs. Repeated failed payments or chargebacks may result in permanent restriction from placing future orders.
7. Shipping, Handling, and Delivery
7.1. Shipping Method
Products are shipped via United States Postal Service (USPS) Priority Mail, in compliance with applicable hazardous materials regulations for ground transportation.
7.2. Order Limits per Shipment
Due to USPS hazmat ground-shipping volume restrictions, the maximum quantity per shipment is four (4) units of liquid product. Orders exceeding this quantity may be split into multiple shipments at our discretion, with no additional charge to you.
7.3. Processing and Delivery Time

  • Order processing: typically 1–3 business days from order acceptance

  • Delivery time: typically 3–7 business days after dispatch, depending on destination

These are estimates only and are not guaranteed. We are not liable for delivery delays caused by carriers, weather, holidays, or other factors outside our reasonable control.
7.4. Shipping Cost
Shipping cost is calculated at checkout and is non-refundable except where we have caused the cause for return (e.g., shipping the wrong product, shipping a defective product).
7.5. Address Accuracy
You are responsible for providing a complete and accurate shipping address. Orders shipped to incorrect addresses provided by you, or returned to us as undeliverable, may be subject to re-shipping fees and any applicable restocking fees if you elect to cancel.
8. Risk of Loss and Title Transfer
Title to Products and risk of loss pass to you upon delivery to the carrier (USPS) at our shipping facility.
This means:

  • Once we hand the package to USPS, the Products legally belong to you.

  • Loss, theft, or damage during transit is generally a matter between you and the carrier.

  • However, see Section 10 below for our policy on damaged-in-transit Products — we offer voluntary replacement assistance to maintain customer goodwill.

9. Order Cancellation by Buyer
9.1. Before Dispatch
You may request cancellation of an order before it has been dispatched by contacting us immediately at cleaning.lab.info@gmail.com or (718) 213-8586. If we have not yet dispatched the order, we will cancel it and issue a full refund.
9.2. After Dispatch
Once an order has been dispatched, it cannot be cancelled. Your options are governed by our Returns Policy in Section 10 below.
10. Returns and Refunds
 
Hard rule for chemical product e-commerce: returns are restricted, and refund mechanics are designed to discourage abuse while complying with applicable consumer protection laws.
10.1. Eligible Returns
Returns are accepted only for Products that are:

  • Unopened, factory-sealed, and unused

  • In original packaging with all labels and seals intact

  • Returned within 30 days of the original delivery date

Products that show any signs of having been opened, used, partially used, contaminated, or with damaged packaging are not eligible for return, regardless of reason. This restriction is in place for sanitary, safety, and product integrity reasons in accordance with industry practice for chemical products.
10.2. Return Process
To initiate a return, you must:

  1. Contact us at cleaning.lab.info@gmail.com within 30 days of delivery

  2. Receive a Return Authorization (RA) number from us

  3. Ship the Product back to the address we provide, with the RA number clearly marked on the package

  4. Pay the return shipping cost (return shipping is your responsibility unless the return is due to our error)

  5. Include the original packing slip or order confirmation

Returns sent without a Return Authorization will be refused or returned to you at your expense.
10.3. Restocking Fee
Approved returns are subject to a 15% restocking fee, deducted from the refund amount. Original shipping charges are non-refundable.
10.4. Refund Issuance
Once a return is received and inspected to confirm eligibility under Section 10.1, refunds are issued to the original payment method within 5–10 business days. We will notify you by email when the refund is processed.
10.5. Non-Refundable Items
The following are never refundable:

  • Opened, used, or partially used Products

  • Products damaged after delivery

  • Original shipping charges (unless return is due to our error)

  • Products returned more than 30 days after delivery

  • Products returned without a Return Authorization

10.6. Chargebacks
We strongly prefer to resolve concerns directly. Initiating a chargeback through your bank or payment provider before contacting us, or while we are actively working with you to resolve an issue, may result in restriction from future orders and recovery of associated fees as set forth in Section 6.3.
11. Damaged or Defective Products
11.1. Damaged in Transit
If your Product arrives with visible package damage or product leakage:

  1. Photograph the damage immediately upon receipt — include the shipping box, the product, and the packing slip in clear photos

  2. Contact us at cleaning.lab.info@gmail.com within 7 days of delivery

  3. Provide your order number and the photos

We will, at our sole discretion, send a replacement Product at no additional charge, or assist you in filing a claim with the carrier. Damaged-in-transit complaints submitted after 7 days, or without photographic evidence, will not be honored.
11.2. Defective Products
A "defective" Product is one with a manufacturing defect that materially impairs its intended use (e.g., a malfunctioning sprayer, contaminated formula, mislabeled bottle). Normal product variation, color differences from website images, scent variations, or subjective dissatisfaction do not constitute defects.
If you believe a Product is defective:

  1. Contact us at cleaning.lab.info@gmail.com within 14 days of delivery

  2. Describe the defect and provide photographs

If we determine the Product is defective, our sole remedy is to provide a replacement Product at no charge (including replacement shipping). Cash refunds are not provided for defect claims. This is the buyer's exclusive remedy and our exclusive obligation for defect claims.
11.3. No Coverage for Misuse, Damage, or Surface Issues
Replacements and refunds are not available for:

  • Damage to surfaces, materials, fabrics, or property allegedly caused by Product use (see Section 14)

  • Skin, eye, respiratory, or other personal reactions (see Section 15)

  • Products used in violation of label instructions or Safety Data Sheet (SDS) guidance

  • Subjective dissatisfaction with cleaning results

  • Color, fragrance, or finish variations from website images

12. Express Disclaimer of Warranties
12.1. As-Is Sale Where Permitted
To the maximum extent permitted by applicable law, Products are sold "AS IS" and "WITH ALL FAULTS," and Cleaning LAB INC. expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to:

  • The implied warranty of fitness for a particular purpose

  • Warranties of non-infringement

  • Warranties arising from course of dealing or usage of trade

  • Warranties regarding accuracy of product descriptions, images, or marketing materials

12.2. Limited Implied Warranty
Some jurisdictions do not allow the exclusion of certain implied warranties. In such jurisdictions, any implied warranty of merchantability is limited in duration to 30 days from the date of delivery and is the sole and exclusive warranty applicable to the Products.
12.3. No Reliance on Third-Party Statements
You acknowledge that no statement, recommendation, or assurance by any sales representative, retailer, online reviewer, social media user, or other third party shall create any warranty or modify these Terms.
13. Product Use, Safety, and Customer Responsibility
Cleaning LAB Products are professional-strength cleaning agents containing chemical ingredients. By purchasing and using these Products, you accept full responsibility for safe and proper use.
13.1. Use According to Label and SDS
You agree to:

  • Read the product label completely before each use

  • Review the Safety Data Sheet (SDS) available upon request at cleaning.lab.info@gmail.com or via the SDS request mechanism on our website

  • Use the Product only for its intended purpose as described on the label

  • Follow all instructions, dilutions, and precautions on the label

13.2. Personal Protective Equipment
You are responsible for using appropriate personal protective equipment (PPE) as recommended on the label and SDS, including but not limited to gloves, eye protection, and adequate ventilation.
13.3. Not for Personal or Medical Use
Cleaning LAB Products are intended for cleaning hard surfaces only. They are not intended for:

  • Personal hygiene or body care

  • Skin, hair, or oral application

  • Medical, therapeutic, or pharmaceutical purposes

  • Use on food contact surfaces unless specifically labeled for that purpose

  • Use as a pesticide, disinfectant, or sanitizer unless specifically labeled and registered for that purpose

14. Surface Compatibility and Test Patch Requirement
14.1. Test Before Use
Before using any Product on a surface, fabric, or material, you must test it in a small, inconspicuous area to verify compatibility. Allow the test area to dry completely and inspect for adverse effects (discoloration, etching, dulling, fiber damage) before applying to the full area.
14.2. Customer Assumes Risk for Surface Damage
Surfaces, materials, finishes, and fabrics vary widely in composition, age, condition, and prior treatment. Cleaning LAB cannot anticipate the response of every surface to our Products. You assume all risk of surface damage, and Cleaning LAB shall not be liable for damage to surfaces, fabrics, finishes, fixtures, or other property arising from use of our Products, including damage that becomes apparent only after application.
14.3. Excluded Surfaces
Our Products are not recommended for use on:

  • Untreated natural stone (marble, travertine, limestone) without consultation

  • Aluminum surfaces without dilution as directed

  • Fabrics and upholstery not specifically labeled as compatible

  • Wood surfaces with damaged or no protective finish

  • Electronic equipment, screens, or interior automotive surfaces

15. Allergic Reactions and Personal Sensitivity
Individuals may have varying sensitivities to cleaning chemicals. You are responsible for determining whether you, members of your household, or others who may come into contact with treated surfaces have any sensitivity, allergy, or contraindication to the Product's ingredients.
If you experience any irritation, allergic reaction, respiratory distress, or other adverse reaction:

  • Discontinue use immediately

  • Follow first aid instructions on the product label

  • Contact Poison Control at 1-800-222-1222 (United States) for ingestion, eye contact, or significant exposure

  • Seek medical attention as appropriate

Cleaning LAB shall not be liable for any allergic, sensitivity, or other personal reaction arising from use of, contact with, or proximity to our Products.
16. Mixing, Storage, and Disposal
16.1. Do Not Mix with Other Cleaners
Never mix Cleaning LAB Products with bleach, ammonia, acids, or other household cleaning products. Mixing chemicals can produce toxic gases, fires, or other hazardous reactions. You assume full responsibility for any harm arising from mixing or improper use.
16.2. Storage
Store Products:

  • In their original containers with labels intact

  • Tightly closed when not in use

  • In a cool, dry place

  • Out of reach of children and pets

  • Away from heat, open flames, and incompatible substances

16.3. Disposal
Dispose of Products and packaging in accordance with local, state, and federal regulations. Consult your local waste authority for guidance on hazardous household waste disposal.
17. Children, Pets, and Poison Control
KEEP OUT OF REACH OF CHILDREN AND PETS.
In case of accidental ingestion, eye contact, or significant skin exposure:

  • Call Poison Control immediately: 1-800-222-1222 (United States)

  • Follow first aid instructions on the product label

  • Seek emergency medical attention as needed

Cleaning LAB shall not be liable for any injury, illness, or death arising from accidental exposure, ingestion, or contact with our Products by any person or animal.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • CLEANING LAB INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including but not limited to lost profits, lost business, loss of use, loss of data, property damage, personal injury, or pain and suffering, arising from or related to the purchase, use, misuse, or inability to use any Product, even if Cleaning LAB has been advised of the possibility of such damages.

  • OUR TOTAL CUMULATIVE LIABILITY for any claim arising from or related to a specific Product order, regardless of the form of action (contract, tort, strict liability, statutory, or otherwise), shall not exceed the total amount actually paid by you for the specific Product giving rise to the claim.

  • These limitations apply notwithstanding the failure of any limited remedy of its essential purpose.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
19. Indemnification
You agree to indemnify, defend, and hold harmless Cleaning LAB INC., its officers, directors, employees, contractors, suppliers, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to:

  • Your breach of these Terms

  • Your use, misuse, or storage of any Product

  • Your violation of any applicable law, regulation, or third-party right

  • Damage or injury caused by your application of the Product to any surface, person, or animal

  • Claims by any third party (family members, guests, neighbors, tenants, employees, customers) arising from your use, storage, or handling of the Product

20. Customer Reviews and Submitted Content
If you submit a review, photo, or other content related to a Product (whether on our website, our social media, or third-party platforms with reference to our Products), you grant Cleaning LAB a non-exclusive, royalty-free, worldwide, perpetual, sublicensable license to use, reproduce, modify, adapt, publish, translate, and display such content for any business purpose, including marketing.
You represent and warrant that:

  • The content is your own original work

  • The content is accurate and reflects your genuine experience

  • The content does not infringe any third-party rights

  • The content does not contain false, defamatory, harassing, or unlawful material

We reserve the right to remove, edit, or refuse to publish any submitted content at our sole discretion.
21. Promotions, Discounts, and Coupon Codes

  • Promotional codes, discounts, and coupons are valid only for the period and conditions stated

  • One promotion or discount code per order, unless otherwise stated

  • Promotions cannot be combined unless explicitly allowed

  • Promotional discounts are not redeemable for cash and have no cash value

  • We reserve the right to cancel, modify, or refuse promotions in cases of suspected fraud, abuse, or system error

22. Force Majeure
Cleaning LAB shall not be liable for any failure or delay in performance arising from causes beyond our reasonable control, including but not limited to: acts of God, weather, natural disasters, pandemics, epidemics, governmental actions or regulations, civil unrest, war, labor disputes, carrier delays, supply chain disruptions, raw material shortages, utility failures, or cyberattacks.
23. Privacy and Communications
Your personal information is handled in accordance with our Privacy Policy. By placing an order, you consent to receive order-related communications, including order confirmations, shipping notifications, delivery updates, and customer service messages, as further described in our SMS & Communication Policy.
24. Governing Law and Dispute Resolution
24.1. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
24.2. Jurisdiction
Any dispute, claim, or controversy arising from or relating to these Terms or your purchase of Products shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.
24.3. Time Limit on Claims
Any claim arising from or related to these Terms or your purchase must be brought within one (1) year after the cause of action accrues, or such claim is permanently barred.
24.4. Class Action Waiver
To the maximum extent permitted by law, you agree that any dispute will be resolved on an individual basis and not as part of any class, consolidated, or representative action.
25. General Provisions
25.1. Severability
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
25.2. Entire Agreement
These Terms, together with our Privacy Policy, SMS & Communication Policy, and Terms of Service, constitute the entire agreement between you and Cleaning LAB INC. regarding the purchase of Products, superseding any prior agreements, communications, or representations.
25.3. No Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other.
25.4. Assignment
You may not assign these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or similar business transaction.
25.5. Notices
Legal notices to Cleaning LAB INC. must be sent in writing to the email address or mailing address listed in Section 26. Notices are deemed delivered upon email delivery confirmation or three business days after postal mailing.
25.6. Headings
Section headings are for convenience only and do not affect interpretation of these Terms.
25.7. Survival
Sections 8 (Risk of Loss), 12 (Warranty Disclaimer), 13–17 (Product Use and Safety), 18 (Limitation of Liability), 19 (Indemnification), 23 (Privacy), 24 (Governing Law), and 25 (General Provisions) survive termination or expiration of these Terms.
25.8. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Material changes will be posted on this page with a revised effective date. Orders placed after the effective date of revised Terms are governed by the revised Terms.
