Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your use of the Cleaning LAB INC. website (the "Site") and our professional cleaning services ("Services"). Cleaning LAB INC. ("Cleaning LAB," "we," "our," or "us") provides residential and commercial cleaning services in New York City.

These Terms apply to your use of our website and our cleaning services. For purchases of cleaning products through our online store, please refer to our separate Terms of Sale.

By accessing the Site, requesting a quote, scheduling a service, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our SMS & Communication Policy. If you do not agree, do not use our Site or Services.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding agreements to use our Site or Services. By using the Site or requesting Services, you represent and warrant that you meet these eligibility requirements.

If you are requesting Services on behalf of another person or entity (such as a building manager, landlord, or business owner), you represent that you have authority to bind that person or entity to these Terms.

3. Scope of Services

Cleaning LAB provides professional cleaning and related services, including but not limited to:

  • Couch Cleaning

  • Chair Cleaning

  • Mattress Cleaning

  • Upholstery Repair

  • Carpet Cleaning

  • Carpet Pickup & Off-Site Cleaning

  • Steam Cleaning of Bathroom Tiles and Grout

  • Silicone Sealant Replacement

  • Deep Mini-Split AC Cleaning

All Services are provided based on the condition of the materials, surfaces, and equipment at the time of service. We may add, modify, or discontinue Services at our discretion.

4. Service Performance and Limitations

4.1. No Guarantee of Specific Results

While we use professional equipment, techniques, and industry-standard methods, we do not guarantee specific outcomes, including but not limited to:

  • Complete stain removal

  • Full restoration of color or texture

  • Elimination of all odors, mold, or discoloration

Results may vary depending on material type, age, prior treatments, level of wear, contamination level, and hidden or pre-existing conditions.

4.2. Material Condition and Pre-Existing Damage

You acknowledge that:

  • Some materials may be fragile, aged, worn, or previously damaged

  • Certain defects may not be visible prior to service

  • Cleaning agents, steam, moisture, heat, or agitation may reveal pre-existing damage that was not apparent before service

Cleaning LAB is not responsible for:

  • Pre-existing wear, fading, discoloration, or fiber deterioration

  • Shrinkage, color bleeding, texture changes, or weakened materials caused by age or prior use

  • Damage resulting from previous cleaning attempts or improper maintenance

4.3. Upholstery Repair Services

Upholstery repair services are limited to minor, visible repairs and do not reinforce or rebuild structural areas unless explicitly agreed in writing prior to service.

4.4. Silicone Sealant Replacement

Silicone sealant replacement services involve removal and reapplication of sealant only. Cleaning LAB does not guarantee waterproofing beyond the applied sealant line and is not responsible for underlying structural, plumbing, or moisture issues.

4.5. Off-Site Carpet Cleaning

For carpet pickup and off-site cleaning services:

  • Carpets are transported to and from an external facility for cleaning

  • Estimated turnaround time is 5–9 business days, unless otherwise stated

  • Processing time may vary depending on size, condition, and current workload

Carpets transported off-site are handled with reasonable care, but Cleaning LAB's liability for loss or damage during transport or off-site processing is limited to the cost of the cleaning service or $500, whichever is greater. Clients with high-value carpets (antique, custom, or heirloom) are encouraged to maintain their own insurance coverage and to disclose the value of the carpet at the time of pickup.

4.6. Mini-Split AC Cleaning

Deep Mini-Split AC Cleaning is a maintenance and cleaning service only. It does not:

  • Repair mechanical, electrical, or refrigerant failures

  • Guarantee improved performance beyond improvements resulting from cleanliness

  • Replace parts or correct manufacturer or installation defects

We are not responsible for issues arising from pre-existing system defects, age, corrosion, refrigerant leaks, or manufacturer-related problems.

5. Service Area

Cleaning LAB currently provides Services in the five boroughs of New York City (Manhattan, Brooklyn, Queens, Bronx, and Staten Island). Service requests outside this area may be subject to travel fees or declined at our discretion.

6. Access and Work Environment

You are responsible for:

  • Providing safe and reasonable access to the service area

  • Removing personal items, valuables, and breakables from the work zone

  • Ensuring that utilities (electricity, water, ventilation) are available and functional when required for service

  • Disclosing any known hazards (mold, asbestos, infestations, structural issues) prior to service

We reserve the right to refuse, pause, or stop service if conditions are unsafe, unsanitary, or unsuitable for professional service.

7. Photo Authorization

By scheduling Service, you authorize Cleaning LAB to take photos and short videos of materials, surfaces, equipment, and work areas for the purposes of:

  • Service preparation and documentation

  • Internal quality control

  • Training of our technicians

In addition, photos may be used in anonymized form (with no personal identifying information, addresses, or private details visible) for educational, demonstrational, or promotional purposes, including before-and-after examples on our website or social media. Full details of how we handle photos are described in our Privacy Policy.

8. Pricing and Minimum Service Charge

  • A minimum service charge of $150 per visit applies to all Services

  • Optional add-on services may be combined to meet the minimum

  • Pricing is based on information provided by you in advance of service and may change if actual on-site conditions differ materially from what was described

  • Final pricing is confirmed on-site when applicable, prior to commencement of work

9. Payments

We accept payments via:

  • Cash

  • Zelle

  • Credit and debit card

  • Other approved online payment methods

Payment is due upon completion of Service unless otherwise agreed in writing in advance.

9.1. Failed Payment and Chargebacks

If a payment is declined, reversed, or charged back after Service has been completed, you remain responsible for the full Service amount. A processing fee of $25 may apply to recover collection costs. Repeated failed payments or chargebacks may result in refusal of future Service.

10. Cancellation and Refund Policy

10.1. Cancellation by Client

  • More than 24 hours before scheduled service: Free cancellation or rescheduling, no charge.

  • Less than 24 hours before scheduled service: A late cancellation fee of $75 applies, payable before any future service can be scheduled.

  • Day-of cancellation, no-show, or refusal of service upon arrival: Full minimum charge of $150 applies.

10.2. Cancellation by Cleaning LAB

We may cancel or reschedule a service appointment due to weather, equipment issues, illness, staffing, or other operational factors. If we cancel, you will not be charged, and we will work with you to reschedule at a mutually convenient time. We are not liable for any indirect costs you may incur as a result of our cancellation.

10.3. Re-Cleaning for Dissatisfaction

If you are dissatisfied with the result of a Service, you must notify us within 48 hours of service completion. We will return at no additional charge to re-clean the disputed area, provided the dissatisfaction relates to work performed and not to pre-existing damage, material limitations, or conditions described in Section 4.

10.4. No Cash Refunds for Completed Services

Because cleaning services involve labor, equipment time, and consumables that cannot be reversed, all completed services are final. We do not provide cash refunds. Our re-cleaning policy in Section 10.3 is the exclusive remedy for service dissatisfaction. Any disputes that cannot be resolved through re-cleaning are subject to Section 22 (Governing Law and Jurisdiction) below.

11. Right to Refuse Service

Cleaning LAB reserves the right to refuse, suspend, or discontinue Service in cases including, but not limited to:

  • Unsafe or unsanitary working conditions

  • Misrepresentation of service scope, conditions, or property ownership/authority

  • Inappropriate, threatening, or abusive behavior toward our staff

  • Conditions beyond our reasonable service capability

  • Discovery of conditions requiring specialized professionals (mold remediation, biohazards, etc.)

If we refuse or stop service partway, we may charge for time and materials already expended, up to the minimum service charge.

12. Website Use

12.1. Acceptable Use

You may use the Site to learn about our Services, request quotes, schedule appointments, contact us, leave reviews where applicable, and (through our online store) browse and purchase products under our Terms of Sale.

12.2. Prohibited Activities

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms

  • Attempt to gain unauthorized access to any portion of the Site, our servers, or related systems

  • Use automated tools (bots, scrapers, crawlers) to access, copy, or extract content from the Site without written permission

  • Reverse engineer, decompile, or disassemble any part of the Site or its underlying technology

  • Interfere with, disrupt, or attempt to overload the Site

  • Submit false, misleading, or fraudulent information, including in service requests, product reviews, or contact forms

  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

  • Upload or transmit viruses, malware, or any harmful code

  • Use the Site to harass, abuse, or harm another person

We may terminate or restrict your access to the Site at any time for violation of these Terms, without notice.

12.3. Intellectual Property

All content on the Site — including the Cleaning LAB name and logo, text, graphics, photographs, videos, design, layout, and software — is owned by Cleaning LAB or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, publish, transmit, or create derivative works from any Site content without our prior written permission, except for personal, non-commercial use of publicly available information.

12.4. User-Generated Content

If you submit content to the Site (including but not limited to product reviews, photos in connection with reviews, comments, or testimonials), you grant Cleaning LAB a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, and display such content in connection with our business, including for marketing and promotional purposes. You represent that you own or have all necessary rights to the content you submit and that it does not infringe any third-party rights.

We reserve the right to remove or refuse to publish any user-generated content at our sole discretion.

12.5. DMCA Notices

If you believe content on the Site infringes your copyright, please send a notice to cleaning.lab.info@gmail.com containing:

  1. Identification of the copyrighted work claimed to be infringed

  2. Identification of the allegedly infringing material and its location on the Site

  3. Your contact information (name, address, phone, email)

  4. A statement that you have a good faith belief that use is not authorized by the copyright owner

  5. A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner

  6. Your physical or electronic signature

We will respond to valid DMCA notices in accordance with the Digital Millennium Copyright Act.

13. Privacy and Communications

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By providing your phone number or email address, you consent to receive service-related communications (including SMS, calls, and emails) as described in our SMS & Communication Policy.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • CLEANING LAB INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES.

  • OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A SPECIFIC SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THAT SERVICE.

  • OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO USE OF THE SITE (NOT INVOLVING A PAID SERVICE) SHALL NOT EXCEED $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Cleaning LAB INC., its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

  • Your breach of these Terms

  • Your misuse of the Site or our Services

  • Your violation of any law or third-party right

  • Claims by third parties (including building owners, neighbors, or other residents) related to your property, premises, or actions

16. Force Majeure

Cleaning LAB shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, severe weather, natural disasters, pandemics, epidemics, governmental actions, civil unrest, strikes, utility failures, transportation disruptions, or supply chain interruptions. In such cases, we will work in good faith to reschedule affected services.

17. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Material changes will be posted on this page with a revised effective date. Continued use of the Site or Services after such changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, discontinue use of the Site and Services.

18. General Provisions

18.1. Severability

If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

18.2. Entire Agreement

These Terms, together with our Privacy Policy, SMS & Communication Policy, and (where applicable) Terms of Sale, constitute the entire agreement between you and Cleaning LAB INC. regarding your use of the Site and Services, superseding any prior or contemporaneous agreements, communications, or representations.

18.3. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Cleaning LAB.

18.4. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or similar business transaction.

18.5. Notices

Legal notices to Cleaning LAB INC. must be sent in writing to the email address or mailing address listed in Section 19. Notices are deemed delivered upon email delivery confirmation or three business days after postal mailing.

18.6. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.
